What Is Goa RERA and Why Does It Matter to You?
The Real Estate (Regulation and Development) Act, 2016 — commonly called RERA — was enacted by the Indian Parliament to bring transparency, accountability and fairness to the real estate sector. In Goa, the Goa Real Estate Regulatory Authority (Goa RERA) was formally notified on 24 November 2017 and an online portal launched in 2018. Before RERA, buyers had very little protection against developer delays, fund misuse, or misleading advertisements. RERA fundamentally changed this: every developer must now register their project, disclose all approvals and financials publicly, deposit 70% of collected funds in a dedicated escrow account, and deliver on schedule or face penalties.

How to Check if a Project Is RERA Registered
Before buying any apartment or villa in a developer project in Goa, verify RERA registration. Visit rera.goa.gov.in and use the Search function: enter the project name or the developer's name, or input the alphanumeric RERA ID that all registered projects carry. The registration page will show you approved layout plans, completion timelines, how many units have been sold, financial disclosures, and current project status. Any advertisement for a RERA-eligible project must display the RERA registration number — if it does not, that is a red flag and the developer may be in violation of law.
Your Rights as a Buyer Under Goa RERA
RERA grants buyers several legally enforceable rights that did not exist before 2017. These include: the right to full project information (plans, approvals, timelines, construction status) before and after purchase; the right to receive possession by the committed date, failing which the developer must refund the entire amount with interest or pay compensation; the right to receive a properly maintained building for 5 years post-possession; and the right to form a Residents' Welfare Association (RWA) or similar body to manage the common areas of the building. If a developer changes the project plan in any material way, your consent as a buyer is required.

How to File a Complaint with Goa RERA
If you have a grievance against a developer or registered agent — including project delays, failure to deliver as promised, refund denial, or false advertising — you can file a complaint directly with Goa RERA. The process is entirely online. Visit rera.goa.gov.in, click on "Complaint Register," fill in the Complaint Registration Form with accurate details, upload supporting documents (sale agreement, payment receipts, correspondence with the developer), pay the ₹5,000 filing fee online, and submit. You will receive a reference number to track your complaint's progress. RERA is required to hear and decide on your complaint within 60 days. If you are not satisfied with RERA's order, you can appeal to the Goa RERA Appellate Tribunal, and if still unsatisfied, to the Bombay High Court (Goa Bench).
Developer Penalties for Non-Compliance
RERA has real teeth. A developer who markets or sells an unregistered project faces a penalty of up to 10% of the project cost, plus possible imprisonment up to 3 years. A registered agent operating without a valid RERA licence faces ₹10,000 per day of default, capped at 5% of the project cost. Providing false information attracts a 10% project cost penalty. Non-compliance with RERA orders carries a 5% penalty, and non-compliance with Appellate Tribunal orders attracts up to 10% plus possible imprisonment up to 3 years. The 2025 RERA 2.0 amendments have tightened these compliance standards further, introducing stronger project monitoring mechanisms and raising penalties for non-registration.
Red Flags: When to Stop and Investigate
- Developer refuses to share RERA registration number
- Advertisement does not display RERA ID
- Developer asks for more than 10% before signing a registered agreement
- Promises construction timelines with no written commitment in agreement
- No escrow account details provided when requested
- Quarterly updates not available on RERA portal
- Layout plans shown verbally or in brochure only — not on the RERA portal
RERA for Plot Purchases and Resale Properties
RERA primarily applies to new projects above the threshold. If you are buying a resale apartment from an individual (not a developer), RERA registration is not applicable to that transaction — but you should still check whether the original project was registered and verify that the seller has a clear title and Occupancy Certificate. For plot purchases in layouts developed by promoters above the 500 sq.m threshold, RERA registration is required and you should verify layout approvals and development permissions on the portal. For individual plot purchases from landowners, RERA does not apply but full legal due diligence on title, zoning, and development permissions remains essential.
